AK Wins Case Against Excessive Fees in Magenta Mobile Contracts

Consumer advocates at the Austrian Chamber of Labor (AK) have successfully challenged clauses in Magenta’s mobile contracts. Sixteen provisions were affected, including excessive default interest, unlawful return fees, and dunning charges, the AK announced on Monday. Customers are advised to review potential reimbursement claims. According to Magenta, many of the clauses are no longer applied.

The AK reported that Magenta charged customers default interest of around 12 percent—exceeding legal limits. Additionally, the company imposed flat dunning fees of up to €17 without considering whether they were proportionate to the invoice amount. In a settlement, Magenta agreed not to use such clauses in future contracts.

The AK recommends that customers check their bills for these fees and charges and contact Magenta directly with any reimbursement claims. A template letter is available on the AK website at https://go.apa.at/qXYmJ84F.

Magenta told APA that most of the challenged clauses are “largely obsolete,” many inherited from former UPC contracts. “Many clauses have not been applied for a long time and are no longer used for billing. Magenta places great value on transparent and understandable contract terms. The settlement with the Chamber of Labor also served to update our terms and provide legal clarity,” the company stated.
